1. Purpose
These terms of use govern your use of:
- the website www.amaspark.com;
- the Amaspark account, used to sign in to Amaspark apps.
An Amaspark app may have additional terms, which will be shown to you in the app.
2. Provider
The website and the Amaspark account are provided by Anas MAROUF EI, trading as AMASPARK (“Amaspark”, “we”). Contact details are in the legal notice.
3. Acceptance
By using the website, you accept the terms that apply to it. By creating an Amaspark account, you accept all of these terms. If you do not accept them, do not use the service.
4. The website
The website is free to access. We do our best to keep it available and accurate, but it may be interrupted, for example for maintenance, and its content may change.
The website contains links to third-party websites. We do not control their content, which is the responsibility of their publishers.
5. The Amaspark account
5.1 Creating an account
The Amaspark account is free. To create one, you must be at least 15 years old and give a valid email address that belongs to you, or use your Google account.
5.2 Keeping your account secure
You are responsible for keeping your password confidential. Choose a password you do not use anywhere else. If you think someone else is using your account, change your password and tell us at security@amaspark.com.
5.3 Acceptable use
You agree not to:
- use another person’s account, or create an account in someone else’s name without their consent;
- create accounts automatically or in bulk;
- try to bypass security measures, access the service without authorisation or disrupt it;
- use the service for unlawful purposes.
5.4 Suspension
In case of a serious breach of these terms, or to protect the service or other users, we may suspend or close an account. Except in an emergency or where the law requires otherwise, we tell you beforehand by email and give the reason, and you can reply.
5.5 Deletion by you
You can delete your account at any time, free of charge and without giving a reason: see Delete your Amaspark account.
5.6 Changes to and end of the service
The service may change. If we decide to stop the Amaspark account, we will tell you by email at least 30 days in advance, then delete the data as described in the privacy policy.
6. Intellectual property
The website, the apps and their content (texts, logo, graphics, code) are protected. These terms do not transfer any intellectual property right to you; they only allow you to use the service for your personal use.
7. Liability
We provide the website and the Amaspark account with care. We are not liable for damage resulting from use that does not comply with these terms, from your own fault, from the act of a third party or from force majeure.
Nothing in these terms limits the rights the law gives you as a consumer, or your right to compensation if we fail to meet our obligations.
8. Personal data
How we process your data is described in the privacy policy.
9. Changes to these terms
We may change these terms, for example to follow changes in the service or in the law. The version in force is published on this page with its date. For any significant change, we inform account holders by email at least 30 days before it takes effect. If you do not accept the new version, you can delete your account.
10. Governing law and disputes
These terms are governed by French law. If there is a problem, please write to us first at contact@amaspark.com: we will look for an amicable solution. Otherwise, the dispute will be brought before the competent courts; if you are a consumer, you may go to the court of your place of residence or of the place where the damage occurred.
The French version of these terms prevails.
